Jim Hexter & Jobs marking locations

Shootout: Pay 1 ghost rock to the controller of the opposing posse’s leader or mark to make Jim a stud.

I own Jim, and send him into a job I run that marks a location my opponent doesn’t control (like the town square or one of my deeds they don’t have any dudes on). My opponent isn’t the leader in this case, and doesn’t control the mark, so can I use Jim’s ability?

More pertinent question: if a player doesn’t own or control the mark, but decide to defend against a job, are they still considered the mark?

This should provide clarity in both multiplayer and how the card is designed to work. We will update the rewording as such in the compendium!
